1. Cancellation Policy:
1.1 All appointments for personal training will be scheduled directly between the personal trainer and the client.
1.2 If a client has to cancel or reschedule any previously scheduled appointments, subject to clause
1.5 below, the client must contact the personal trainer scheduled to take the session directly at least 24 hours in advance of the scheduled appointment.
1.3 If a client does not cancel or reschedule an appointment at least 24 hours in advance, we reserve the right to charge a cancellation fee equivalent to a full personal training fee that would normally be charged for that training session (i.e. no refund will be made).
1.4 If a client fails to appear for a scheduled appointment, we reserve the right to charge a no show fee equivalent to the fee that has been / would have been charged for the training session.
1.5 All cancellations must be made 24 hours in advance by phone or email or by other means which is confirmed as received by the trainer within 1 hour of sending the notification.
5. Indemnity, Release & Waiver:
I hereby indemnify and release Evolve Wellness L.L.C., and each of their respective officers, directors, agents, affiliates, employees, contractors, service providers (collectively, the “Indemnified Parties”) from any and all claims, damages, demands, rights of action or causes of action, present or future, known or unknown, anticipated or unanticipated, arising out of or in any manner resulting from my attendance at or use of equipment or facilities and / or any training (and including but not limited to any contact exercise such as sparring) delivered by Evolve Wellness L.L.C., including without limitation any claims, damages, demands, rights of action or causes of action resulting from or arising out of the negligence of the Indemnified Parties. Further, I hereby agree to waive any and all of such claims, damages, demands, and rights of action or causes of action and such activity will be covered by this release and waiver. Such release and waiver is to be binding upon my heirs, executors, administrators and assigns. Further, I hereby agree to release and discharge the Indemnified Parties from any and all liability for any loss or theft, or damage to, personal property owned by myself.
2. Client Punctuality, Holidays & Absences:
If a client is late, they run the risk of losing their appointment and being charged. Clients are responsible for contacting the trainer if he/she will be more than five minutes late. Trainers are responsible for waiting 15 minutes for late arrivals. Clients will only receive the remaining portion of their session. If a trainer is late for a session, the time is owed to the client. This may be done during that particular session or time should be added to a future session. We request 7 days advance notice be given of any prolonged training absences. Your trainer will provide you with at least 7 days notice for any prolonged trainer absences such as vacations. Your trainer will discuss alternative personal training arrangements with you during their absence.
6. Image Rights:
We sometimes film or photograph sessions or the venue where it is taking place so it is possible you will appear in the background. By accepting our terms and conditions, you agree that you will allow us to use your image in promotional and other business-related material.
Your personal information will only be used by Evolve Wellness L.L.C. to provide you with the training services that you have engaged us for. You may be required to enter into separate terms and conditions at the venue where our service is delivered.
All sessions and packages must be completely used within 30 days of the purchase date or forfeited.
3. Payment & Refund Policy:
Payment for sessions must be made at the time of booking. Once purchased, your sessions (including both personal training and classes) are non- refundable and non transferable. Group sessions are for 2 people or more people. In the event of one or more persons being unable to attend a session and one person still attends, the session is marked as a full session for the entire group.
4. Out of Zone Fee:
Out of zone fee is applicable if the client location is 20 km away from B/Attitude Spa, Beverly Hills West bay. The client is responsible to pay the taxi fee of Trainer.
9. Promising you are in Good Health:
Notwithstanding any medical condition that you have informed us about already, the day you enter into any agreement to train with us and each time you train with us, you promise us that you are in good physical condition; you know of no medical or other reason why you cannot or should not do active or passive exercise.
